Seller Terms and Conditions

These Seller Terms and Conditions (“Terms”) govern the participation of fashion product sellers on [Your Fashion Marketplace Name] (operated by MOBITEL DIGITAL OPC PRIVATE LIMITED). By registering and listing your products, you agree to the following terms.
1. Eligibility to Sell
To become a seller on our platform, you must:
- Be a registered business or individual with valid identification
- Have a PAN card and a bank account
- If applicable, be GST-registered
- Provide accurate business details and bank information
2. Product Listing Guidelines
Sellers can only list products under fashion categories, such as:
- Clothing (Men, Women, Kids)
- Footwear
- Accessories (Bags, Jewellery, Sunglasses, etc.)
All listings must:
- Be original and not copied from other sellers or websites
- Include clear images (minimum 2 per product)
- Accurately describe material, size, fit, and brand
- Comply with Indian laws and not include counterfeit or restricted items
3. Order Fulfillment
Sellers are responsible for:
- Processing and shipping orders within 24–48 hours
- Using proper packaging to protect fashion items from damage
- Updating inventory in real-time to avoid cancellations
Repeated delays or cancellations may result in temporary or permanent suspension from the platform.
4. Returns, Refunds & Exchanges
Fashion items are eligible for return/exchange based on sizing, fit, or quality concerns. Sellers must:
- Accept return requests as per the platform’s return policy
- Cooperate in product pickups and refunds
- Avoid selling used, damaged, or poor-quality products
Returned items will be sent back to the seller if found in a resellable condition. Logistics charges may be adjusted in the seller’s next payment cycle.
5. Product Quality and Authenticity
Sellers must ensure:
- Products listed are 100% genuine
- Sizes and measurements match the description
- No replicas, used, or defective items are sent to customers
Failure to meet quality standards may result in penalties, order cancellation, or a permanent ban from the platform.
6. Pricing and Discounts
- Sellers have the right to set their own prices
- Platform-wide discounts or offers may be applied with prior notification
- Sellers are encouraged to keep competitive pricing to improve visibility
7. Commission and Fees
MOBITEL DIGITAL OPC PRIVATE LIMITED charges a commission per sale based on product category. This fee, along with payment gateway charges and applicable taxes, will be deducted before the payout.
Full fee details will be shared during onboarding and are subject to change with prior notice.
8. Taxes and Compliance
- Sellers must comply with Indian tax laws including GST, where applicable.
- TDS may be deducted from your earnings, and certificates will be issued annually.
9. Suspension and Termination
Your seller account may be suspended or terminated for:
- Repeated customer complaints
- Selling counterfeit or poor-quality products
- Violation of platform policies
- Inactivity for more than 90 days
In case of termination, all dues will be settled within 30 days.
10. Data & Confidentiality
- Seller data and customer information must not be misused or shared.
- Any violation of customer privacy will lead to immediate termination and legal action.
11. Dispute Resolution
In case of any disagreement or dispute:
- Sellers must first contact our support team.
- If unresolved, disputes will be subject to the jurisdiction of Delhi courts only.
